2. Description of services

Alerteon is a marketing agency providing targeted advertising services, including:

• setup and management of TikTok Ads campaigns;
• setup and management of Instagram/Meta Ads campaigns;
• consulting on promotion strategy;
• receiving and handling inbound inquiries (leads) submitted via Instagram Direct, comments, WhatsApp, and the website, on behalf of the agency's clients and for the agency's own commercial activity.

The specific scope of services, timelines, and pricing are defined in a separate agreement (in written or electronic form) concluded individually with each client.

3. The website and correspondence are not a public offer

Information published on the website https://alerteon.com, on social media, and in correspondence with agency representatives (including Instagram Direct and WhatsApp) is informational and advisory in nature and does not constitute a public offer within the meaning of the civil legislation of the Kyrgyz Republic. The terms of specific services, pricing, and deadlines are negotiated individually and set out in a separate agreement or invoice.

4. Use of communication channels (Instagram, WhatsApp)

By contacting us via Instagram Direct, comments, or WhatsApp, you agree that:

• the conversation is used to provide consultation and to discuss our services with you;
• your data is processed in accordance with our Privacy Policy;
• we may transfer the conversation into our own self-hosted CRM system (Chatwoot) so agency staff can handle inquiries efficiently;
• we do not guarantee an instant reply — inquiries are handled during the agency's business hours.

5. Ad account authorization (TikTok Ads)

To manage advertising and provide reporting, you grant us access to your ad account through an official authorization mechanism (for example, OAuth via the TikTok Marketing API). By granting access, you confirm that you are the rightful owner of, or are authorized to manage, that account, and you instruct us to perform advertising-related actions on your behalf. You may revoke access at any time.

6. User obligations

The User agrees to:

• provide accurate information when contacting us (name, contact details, business information);
• comply with the rules of the advertising platforms (TikTok, Meta, and others) and applicable law;
• refrain from using the agency's communication channels to send spam, abusive content, or unlawful material;
• refrain from attempting unauthorized access to the agency's internal systems (website, CRM, servers).

7. Intellectual property

All materials on the website https://alerteon.com (text, design, logo, graphics), unless stated otherwise, belong to Alerteon or are used under a lawful license. Copying or using these materials without written consent is prohibited, except as expressly permitted by law.

8. Limitation of liability

• We make reasonable efforts to ensure the accuracy of information on our website and in correspondence, but we do not guarantee it is free of errors or inaccuracies.
• We are not liable for the results of advertising campaigns unless expressly agreed otherwise in a services agreement (KPIs, performance guarantees, etc. are set out separately).
• We are not liable for disruptions in third-party platforms (Meta/Instagram, WhatsApp, TikTok, hosting providers) on which the availability of our communication channels depends.
• Nothing in these Terms limits any liability that cannot be limited under the laws of the Kyrgyz Republic.

9. Third-party services

To provide our services, we use third-party platforms and services (the TikTok Marketing API, the Meta/Instagram API, WhatsApp, Cloudflare, and OpenAI as an AI assistant that helps draft replies). Use of these services is also governed by their own respective terms of use and privacy policies.

10. Governing law

These Terms are governed by and construed in accordance with the laws of the Kyrgyz Republic. Any disputes arising in connection with these Terms shall be resolved in the manner established by the laws of the Kyrgyz Republic, at the location of the Data Controller, unless otherwise provided in a separate agreement.

11. Changes to these Terms

We may update these Terms from time to time. The current version is always available at https://alerteon.com/terms. Continued use of our communication channels after changes are published constitutes acceptance of the updated Terms.
